Stolen vehicle charge

Detective Anthony Sasso reports that on Dec. 7, 2015, members of the Johnston Police Department Patrol Division received a complaint from a party with information regarding a stolen motorcycle.

The complaining party reportedly told police than on Oct. 3, 2013, he had allowed a man to use his Can-Am Spyder motorcycle, described as a three-wheel “trike.” The complaining party told police on the same date, he received a call from the man who borrowed the vehicle indicating it had been stolen in Connecticut. It was subsequently reported as stolen to Connecticut State Police.

Sasso’s report includes a passed from the Connecticut police report, in which the man who borrowed the motorcycle indicated he had been traveling on Route 6 in Killingly, Conn., on the date in question when the vehicle experienced a mechanical failure. The man in that report is said to have indicated he pulled the vehicle over and was picked up by his girlfriend, with the intention of returning in the morning to retrieve the motorcycle.

On Dec. 7, 2015, the complaining party told police he had heard that the man who borrowed the motorcycle still had it in his possession, and was attempting to sell it for $3,000, according to Sasso’s report. The complaining party also indicated the vehicle was being kept in a storage container at CubeSmart on Putnam Avenue in Johnston.

Sasso later responded to CubeSmart and spoke with the general manager, who confirmed the man accused of taking the motorcycle rented a storage container, which was “under ‘foreclosure’ due to non-payment.” The detective reports he sought, and obtained, a search warrant for the container, which was executed on Dec. 22, 2015. That search uncovered a 2013 Can-Am Spyder, which was later verified as the complaining party’s vehicle.

Michael W. Spaziano, 51, of 4 Angell Lane in North Scituate, was arrested and charged with a felony count of possession of a stolen vehicle/parts.

Drug charges

Patrolman Kevin Brady reports being on patrol on Hartford Ave. on the evening of Jan. 14 when he observed a man peering into the window of a residence.

Brady reports he stopped the man and inquired about his activity. The man is said to have indicated he was interested in renting the residence, and was awaiting a real estate agent’s arrival. The patrolman indicates that while he was speaking with the man, a real estate agent did arrive and confirmed the appointment.

Brady asked the man why he was wearing a white hospital gown under his sweatshirt, and the man reportedly indicated he had been discharged from Rhode Island Hospital roughly an hour before the encounter. When the man reached into his pocket to retrieve discharge papers, the patrolman reports observing a “small cellophane baggy containing a white powdery substance” that he “immediately identified” as crack cocaine.

Brady placed the man under arrest and asked if he had additional narcotics on his person. The man reportedly indicated he had more crack cocaine in another plastic bag in his sweatshirt pocket. The patrolman reports he reached into the pocket and retrieved two additional bags – one containing the same substance as the first, and another containing a “brownish powdery substance” he identified as heroin.

The man was transported to police headquarters, and Brady reports the substances tested positive for crack cocaine and heroin, respectively, using field-testing kits.

Hani M. Zaki, 25, of 352 Carpenter St., Apt. 3C, in Providence, was charged with one felony count each of possession crack cocaine and possession of heroin. With no prior criminal history, he was released on $2,000 personal recognizance, with a court date of March 17.
